Terms of Use

These terms govern your use of the Vyaamikk Diary mobile application and this website. Vyaamikk Diary is operated by Ananya Engineered Industrial Components & Pay Systems LLP under the SPECIAL SOFTWARES development brand (the “Operator”). By using the product you agree to these terms.

Eligibility and business use
You must be of legal age to enter a contract in India and use the product for lawful business purposes. If you use the product for an organisation, you represent that you are authorised to bind that organisation.

Account access
Account access is mobile-first. You are responsible for safeguarding your device, mobile number, one-time passwords and any credentials used to reach your workspace. We will never ask you for an OTP or password.

Licence to use
Subject to these terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the application on devices you own or control, solely for your own business record-keeping.

Your content
You retain ownership of the information and content you enter. You grant us a limited permission to process that content only as needed to operate the product for you. For example, to save records, generate documents you request, back up your workspace or send reminders you configure. You are responsible for the accuracy of your content and for having the authority to store any third-party information contained in it.

Acceptable use
You will not use the product to store unlawful content, to impersonate others, to violate anyone’s rights, to distribute malware, to attempt to bypass security controls, to scrape or reverse-engineer the service, or to build a competing product.

No legal, tax, accounting or filing service
Vyaamikk Diary helps you organise records and generate documents from the information you enter. It is not accounting, tax-filing, legal-advice, banking, lending, NBFC, KYC or government-filing software. Generated documents are drawn from your inputs and should be reviewed, and where relevant confirmed with a qualified professional, before commercial, legal, tax or accounting use.

Availability and offline behaviour
Certain features are designed to work offline; others require an internet connection. We do not guarantee uninterrupted service or that backup, restore or export operations will always succeed. Keep your own copies of records that are critical to your business.

Third-party services
The product may use third-party infrastructure and integrations to operate. Those services are governed by their own terms, which will apply to the extent the product interacts with them on your behalf.

Intellectual property
The Vyaamikk Diary name, SPECIAL SOFTWARES mark, the app interface, code and materials are owned by the Operator or its licensors. Nothing in these terms grants you any right in our marks or content other than the limited licence above.

Suspension and account deletion
You may request account deletion at any time using the process on the Delete Account page. We may suspend or terminate access if these terms are breached, if required by law, or if continued use would create serious risk to the service or other users.

Limitation of liability
To the fullest extent permitted by law, the Operator will not be liable for indirect, incidental, consequential, special or exemplary damages, or for loss of profits, revenue, data, goodwill or business opportunity, arising out of or related to your use of the product. Nothing in these terms limits liability that cannot be limited under applicable law.

Indemnity
You will indemnify the Operator against third-party claims arising from your misuse of the product, from content you enter or share, or from your breach of these terms or of applicable law.

Changes
We may update the product and these terms from time to time. Material changes will be reflected here with an updated date and, where appropriate, an in-app notice.

Governing law and disputes
These terms are governed by the laws of India. Any dispute arising out of or in connection with these terms is subject to the jurisdiction of the competent courts in India.
